Disparate Impact

Also known as adverse impact, disparate impact happens when a decision, practice, or policy disproportionately negatively affects a protected group. The disparate impact is unintentional. However, if a legal review following contested employment practices finds a disparate impact, the employer can be held liable and faces fines or other penalties.
